The Insolvency and bankruptcy code, 2016

Part-I Preliminary

Section 1: Short title, extent and commencement.

 (1)      This Code may be called the Insolvency and Bankruptcy Code, 2016.

 (2)      It extends to the whole of India:

            Provided that Part III of this Code Shall not extend to the state of Jammu and  Kashmir.

 (3)      It shall come into force on such date as the Central Government may, by  notification in the Official                                Gazette, appoint:

            Provided that different dates may be appointed for different provisions of this Code and any reference in any                such provision to the commencement of this Code shall be construed as a reference to the commencement of                 that provision.

ભાગ-1 પ્રારંભિક

  વિભાગ 1: ટૂંકું શીર્ષક, હદ અને પ્રારંભ.

(1)        આ કોડને નાદારી અને નાદારી સંહિતા, 2016 કહી શકાય.

(2)       તે સમગ્ર ભારતમાં વિસ્તરે છે:

            જો કે આ કોડનો ભાગ III જમ્મુ અને કાશ્મીર રાજ્ય સુધી વિસ્તરશે નહીં.

(3)    તે કેન્દ્ર સરકાર, સત્તાવાર ગેઝેટમાં સૂચના1 દ્વારા, નિમણૂક કરી શકે તેવી તારીખે  અમલમાં આવશે:

         પૂરી પાડવામાં આવેલ છે કે આ કોડની વિવિધ જોગવાઈઓ માટે અલગ-અલગ તારીખોની નિમણૂક કરવામાં આવી શકે છે અને આ           સંહિતાના પ્રારંભ માટે આવી કોઈપણ જોગવાઈમાંના કોઈપણ સંદર્ભને તે જોગવાઈના પ્રારંભના સંદર્ભ તરીકે  સમજવામાં આવશે.

भाग-I

 प्रारंभिक धारा 1: संक्षिप्त शीर्षक, विस्तार और प्रारंभ।

(1)      इस संहिता को दिवाला और दिवालियापन संहिता, 2016 कहा जा सकता है।

(2)      इसका विस्तार संपूर्ण भारत तक है:

            बशर्ते कि इस संहिता का भाग III जम्मू और कश्मीर राज्य तक विस्तारित नहीं  होगा।

3)    यह उस तारीख से लागू होगा जिसे केंद्र सरकार, आधिकारिक राजपत्र में  अधिसूचना 1 द्वारा, नियुक्त कर सकती है:

         बशर्ते कि इस संहिता के विभिन्न प्रावधानों के लिए अलग-अलग तिथियां   नियुक्त की जा सकें और इस संहिता के प्रारंभ के ऐसे किसी           भी प्रावधान में   किसी भी संदर्भ को उस प्रावधान के प्रारंभ के संदर्भ के रूप में माना जाएगा।

In exercise of the powers conferred by the proviso to sub-section (3) of Section I of the Insolvency and Bankruptcy code, 2016 (31 of 2016), the Central Government hereby appoints the 5th of August, 2016 as the date on which the provisions of Sections 188 to 194 (both Inclusive) of the said code shall come shall come into force.

In exercise of the powers conferred by sub-section (3) of Section I of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the central Government hereby appoints the 19th August, 2016 as the date on which the provisions of following sections of the said Code shall come into force-

નાદારી અને નાદારી કોડ, 2016 (31 નું 2016) ની કલમ I ની પેટા-કલમ (3) ને આપેલ સત્તાઓનો ઉપયોગ કરીને, કેન્દ્ર સરકાર આથી તારીખ 5મી ઓગસ્ટ, 2016 ના રોજ નિમણૂક કરે છે. જે ઉપરોક્ત કોડની કલમ 188 થી 194 (બંને સમાવિષ્ટ) ની જોગવાઈઓ અમલમાં આવશે.

નાદારી અને નાદારી સંહિતા, 2016 (31 નું 2016) ની કલમ I ની પેટા-કલમ (3) દ્વારા આપવામાં આવેલી સત્તાઓનો ઉપયોગ કરીને, કેન્દ્ર સરકાર આથી તારીખ 19મી ઓગસ્ટ, 2016 ની તરીકે નિમણૂક કરે છે કે જેના પર નીચેના વિભાગોની જોગવાઈઓ આ સંહિતા અમલમાં આવશે-

दिवाला और दिवालियापन संहिता, 2016 (2016 का 31) की धारा I की उप-धारा (3) के प्रावधान द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केंद्र सरकार 5 अगस्त, 2016 को उस तारीख के रूप में नियुक्त करती है जिस दिन उक्त संहिता की धारा 188 से 194 (दोनों सम्मिलित) के प्रावधान लागू होंगे।
