The Indian Evidence Act Section 79  

– Presumption as to genuineness of certified copies —

The Court shall presume 1[to be genuine] every document purporting to be a certificate, certified copy or other document, which is by Law declared to be admissible as evidence of any particular fact and which purports to be duly certified by any officer 2[of the Central Government or of a State Government, or by any officer3 [in the State of Jammu and Kashmir] who is duly authorized thereto by the Central Government]:

Provided that such document is substantially in the form and purports to be executed in the manner directed by law in that behalf.

The Court shall also presume that any officer by whom any such document purports to be signed or certified, held, when he signed it, the official character which he claims in such paper.

भारतीय साक्ष्य अधिनियम – प्रमाणित प्रतियों के असली होने के बारे में उपधारणा —

न्यायालय हर ऐसी दस्तावेज का असली होना उपधारित करेगा जो ऐसा प्रमाणपत्र, प्रमाणित प्रति या अन्य दस्तावेज होनी तात्पर्यित है, जिसका किसी विशिष्ट तथ्य के साक्ष्य के रूप में ग्राह्य होना विधि द्वारा घोषित है और जिसका केन्द्रीय सरकार या किसी राज्य सरकार के किसी ऑफिसर द्वारा या जम्मू-कश्मीर राज्य के किसी ऐसे ऑफिसर द्वारा, जो केन्द्रीय सरकार द्वारा इसके लिए सम्यक् रूप से प्राधिकृत हो सम्यक् रूप से प्रमाणित होना तात्पर्यित है:

परन्तु यह तब जबकि ऐसी दस्तावेज सारतः उस प्ररूप में हो तथा ऐसी रीति से निष्पादित हुई तात्पर्यित हो जो विधि द्वारा तन्निमित्त निर्दिष्ट है।

न्यायालय यह भी उपधारित करेगा कि कोई आफिसर, जिसके द्वारा ऐसी दस्तावेज का हस्ताक्षरित या प्रमाणित होना तात्पर्यित है, वह पदीय हैसियत, जिसका वह ऐसे कागज में दावा करता है, उस समय रखता था जब उसने उसे हस्ताक्षरित किया था।

Section 148. power of Appellate Court to order payment pending appeal against conviction

(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973, (2 of 1974), in an appeal by the drawer against conviction under Section 138, the Appellate Court may order the appellant to deposit such sum which shall be a minimum of twenty per cent of the fine or compensation awarded by the trial Court:

Provided that the amount payable under this sub-section Shall be in addition to any interim compensation paid by the appellant under Section 143-A.

(2) The amount referred to in Sub-Section (1) Shall be deposited within sixty days from the date of the order, or within such further period not exceeding thirty days as may be directed by the Court on sufficient cause being shown by the appellant.

(3) The Appellate Court may direct the release of the amount deposited by the appellant to the complainant at any time during the pendency of the appeal:

Provided that if the appellant is acquitted, the Court Shall direct the complainant to repay to the appellant the amount so released, with interest at the bank rate as published by the Reserve Bank of India, Prevalent at the beginning of the relevant financial year, within sixty days from the date of the order, or within such further period not exceeding thirty days as may be directed by the Court on sufficient cause being shown by the complainant.


કલમ-148. ગુના-સાબિતી વિરુધ્ધની અપીલનો નિકાલ બાકી હોય ત્યારે ચુકવણીનો હુકમ કરવાની અપીલ અદાલતની સતા

(1) ફોજદારી કાર્યરીતિ સંહિતા 1973 (સને 1974 નો રજો) માં ગમે તે સમાવિષ્ટ હોય તેમ છતાં, ચેક લખી આપનારે કલમ-138 હેઠળની ગુના-સાબિતી વિરુધ્દ કરેલી અપીલમાં, અપીલ અદાલત, અપીલ કરનારને, સુનાવણી અદાલતે (ટ્રાયલ કોર્ટ) એવોર્ડ કરેલા દંડ અથવા વળતરના ઓછમાં ઓછા 20 ટકા જેટલી રકમ જમા કરાવવાનો હુકમ કરશે.

પરંતુ આ પેટાકલમ હેઠળ ચુકવવાપાત્ર રકમ, અપીલ કરનારને કલમ-143 (ક) હેઠળ ચુકવેલી કોઇ વચગાળાના વળતર ઉપરાંતની રહેશે.

(2) પેટાકલમ-(1) માં જણાવવામાં આવેલી રકમ, હુકમની તારીખથી સાઠ દિવસની અંદર અથવા અપીલ કરનાર દ્રારા પુરતું કારણ દર્શાવવામાં આવ્યેથી અદાલત આદેશ કરે એ મુજબ 30 દિવસથી વધુ નહીં એટલા સમયગાળાની અંદર જમા કરાવવું જોઇશે.

(3) અપીલ અદાલત, અપીલ કરનારને જમા કરાવેલી રકમ અપીલનો નિકાલ બાકી હોય તે દરમિયાન કોઇ પણ સમયે ફરિયાદીને છુટી કરવાનો આદેશ કરી શકશે.

Negotiable Insturments Act, 1881-Complaint u/S. 138-Specifies that all the accused in active connivance mischievously and intentionally issued the cheques in favour of the applellant-No unimpeachable evidence brought on record to indicate that allowing the proceedings to continue would be an abuse of process of the Court-Appeals allowed orders of quashment by the Hon’ble High Court of judicature at Hyderabad for the state of Telangana and state of Andhra pradesh is set aside and that of the Trial Court is restored.
