(iii) A condition that the person shall not leave India without the previous permission of the Court;
(iv)Such other condition as may be imposed under sub- section (3) of section 437, as if the bail were granted under that section
(3) If such person is thereafter arrested without warrant by an officer in charge of a police station on such accusation, and is prepared either at the time of arrest or at any time while in the custody of such officer to give bail, be shall be released on bail; and if a Magistrate taking cognizance of such offence decides that a warrant should issue in the first instance against that person, he shall issue a bailable warrant in conformity with the direction of the Court under sub- section (1) of section 438 CRPC.

આગોતરા જામીન (CRPC કલમ 438 હેઠળ)

CRPC કલમ 438 ધરપકડની ધરપકડ કરનાર વ્યક્તિને જામીન આપવાનો નિર્દેશ.

(1) જ્યારે કોઈ વ્યક્તિ પાસે એવું માનવાનું કારણ હોય કે તેને બિન-જામીનપાત્ર ગુનો કર્યાના આરોપમાં ધરપકડ કરવામાં આવી શકે છે, ત્યારે તે સીઆરપીસી કલમ 438 હેઠળના નિર્દેશ માટે સેશન્સ કોર્ટ અથવા હાઈકોર્ટમાં અરજી કરી શકે છે અને તે કોર્ટ, જો તે યોગ્ય માને છે, નિર્દેશ આપે છે કે આવી ધરપકડના કિસ્સામાં, આરોપી/અરજદારને જામીન પર મુક્ત કરવામાં આવશે.
(2) જ્યારે સેશન કોર્ટ અથવા હાઈકોર્ટ આ કલમની પેટા કલમ હેઠળ કોઈ નિર્દેશ આપે છે
(1), તે ચોક્કસ કેસના તથ્યોના પ્રકાશમાં આવી દિશાઓમાં આવી શરતોનો સમાવેશ કરી શકે છે, કારણ કે તે યોગ્ય લાગે છે, આ સહિત-
(i) એવી શરત કે વ્યક્તિએ જ્યારે જરૂર હોય ત્યારે પોલીસ અધિકારી દ્વારા પૂછપરછ માટે પોતાની જાતને ઉપલબ્ધ કરાવવી;
(ii) એવી શરત કે વ્યક્તિ, પ્રત્યક્ષ કે આડકતરી રીતે, કેસની હકીકતોથી વાકેફ કોઈપણ વ્યક્તિને કોઈ પ્રલોભન, ધમકી અથવા વચન આપી શકશે નહીં જેથી તેને કોર્ટ અથવા કોઈપણ પોલીસ અધિકારીને આવી હકીકતો જાહેર કરવાથી મનાઈ કરી શકાય;
(iii) એવી શરત કે વ્યક્તિ કોર્ટની અગાઉની પરવાનગી વિના ભારત છોડશે નહીં;
(iv) કલમ 437 ની પેટા-કલમ (3) હેઠળ લાદવામાં આવી શકે તેવી અન્ય શરત, જાણે કે તે કલમ હેઠળ જામીન આપવામાં આવ્યા હોય
(3) જો આવી વ્યક્તિ ત્યાર બાદ આવા આરોપમાં પોલીસ સ્ટેશનના ઇન્ચાર્જ અધિકારી દ્વારા વોરંટ વગર ધરપકડ કરવામાં આવે અને તે ધરપકડ સમયે અથવા કોઈપણ સમયે આવા અધિકારીની કસ્ટડીમાં હોય ત્યારે જામીન આપવા માટે તૈયાર હોય, જામીન પર મુક્ત થવું; અને જો આવા ગુનાની સંજ્ઞાન લેતા મેજિસ્ટ્રેટ નક્કી કરે છે કે તે વ્યક્તિ સામે પ્રથમ કિસ્સામાં વોરંટ જારી કરવું જોઈએ, તો તેણે કલમ 438 CRPC ની પેટા-કલમ (1) હેઠળ કોર્ટના નિર્દેશને અનુરૂપ જામીનપાત્ર વોરંટ બહાર પાડવું જોઈએ.

નિયમિત જામીન (CRPC કલમ 437 અને 439 હેઠળ)

જ્યારે કોઈપણ વ્યક્તિ કોગ્નિઝેબલ અને બિનજામીનપાત્ર ગુનો કરે છે ત્યારે પોલીસ તેને કસ્ટડીમાં લેશે. પોલીસ કસ્ટડીની મુદત પૂરી થયા પછી જો કોઈ હોય તો આરોપીને જેલમાં મોકલવો જોઈએ. अग्रिम जमानत (सीआरपीसी धारा 438 के तहत)

सीआरपीसी धारा 438 गिरफ्तारी की आशंका वाले व्यक्ति को जमानत देने का निर्देश।
(1) जब किसी व्यक्ति के पास यह विश्वास करने का कारण हो कि उसे गैर-जमानती अपराध करने के आरोप में गिरफ्तार किया जा सकता है, तो वह सीआरपीसी धारा 438 के तहत निर्देश के लिए सत्र न्यायालय या उच्च न्यायालय में आवेदन कर सकता है और वह न्यायालय, यदि वह उचित समझती है, निर्देश देती है कि ऐसी गिरफ्तारी की स्थिति में, अभियुक्त/आवेदक को जमानत पर रिहा कर दिया जाएगा।
(2) जब सत्र न्यायालय या उच्च न्यायालय इस धारा की उपधारा के तहत कोई निर्देश देता है
(1), इसमें विशेष मामले के तथ्यों के आलोक में ऐसे निर्देशों में ऐसी शर्तें शामिल हो सकती हैं, जो वह उचित समझे, जिनमें शामिल हैं-
(i) एक शर्त कि व्यक्ति आवश्यकता पड़ने पर खुद को पुलिस अधिकारी द्वारा पूछताछ के लिए उपलब्ध कराएगा;
(ii) एक शर्त यह है कि व्यक्ति प्रत्यक्ष या अप्रत्यक्ष रूप से, मामले के तथ्यों से परिचित किसी भी व्यक्ति को कोई प्रलोभन, धमकी या वादा नहीं करेगा ताकि उसे अदालत या किसी पुलिस अधिकारी को ऐसे तथ्यों का खुलासा करने से रोका जा सके;
(iii) एक शर्त कि व्यक्ति न्यायालय की पूर्व अनुमति के बिना भारत नहीं छोड़ेगा;
(iv) ऐसी अन्य शर्तें जो धारा 437 की उप-धारा (3) के तहत लगाई जा सकती हैं, जैसे कि जमानत उस धारा के तहत दी गई थी
(3) यदि ऐसे व्यक्ति को ऐसे आरोप में किसी पुलिस स्टेशन के प्रभारी अधिकारी द्वारा वारंट के बिना गिरफ्तार किया जाता है, और गिरफ्तारी के समय या किसी भी समय ऐसे अधिकारी की हिरासत में जमानत देने के लिए तैयार किया जाता है, तो उसे जमानत देनी होगी जमानत पर रिहा किया जाए; और यदि कोई मजिस्ट्रेट ऐसे अपराध का संज्ञान लेते हुए निर्णय लेता है कि पहली बार में उस व्यक्ति के खिलाफ वारंट जारी किया जाना चाहिए, तो वह धारा 438 सीआरपीसी की उप-धारा (1) के तहत न्यायालय के निर्देश के अनुरूप जमानती वारंट जारी करेगा।

नियमित जमानत (सीआरपीसी धारा 437 और 439 के तहत)

जब कोई भी व्यक्ति संज्ञेय और गैर जमानती अपराध करेगा तो पुलिस उसे हिरासत में ले लेगी। पुलिस हिरासत की अवधि यदि कोई हो, समाप्त होने के बाद आरोपी को जेल भेजा जाना चाहिए। सीआरपीसी की धारा 437 और 439 के तहत ऐसे आरोपी को हिरासत से रिहा करने का अधिकार है तो इसका मतलब है कि नियमित जमानत मुकदमे में उसकी उपस्थिति सुनिश्चित करने के लिए आरोपी को हिरासत से रिहा करना है।

अस्थायी जमानत
