જો કોઈ પક્ષ પહેલેથી જ વિવાહિત હોય અને છૂટાછેડા લીધા ન હોય, તો એવું લગ્ન ધારા 11 મુજબ અમાન્ય રહેશે.


2. ધારા 11 – અમાન્ય લગ્નો:

“જો લગ્ન ધારા 5ની શરતોનું ઉલ્લંઘન કરે છે (ખાસ કરીને 5(i), (iv), (v)), તો એવું લગ્ન અમાન્ય (void) છે અને કોર્ટ તેના માટે ‘decree of nullity’ જાહેર કરી શકે છે.”

એટલે કે, પહેલેથી જ વિવાહિત વ્યક્તિએ કરેલું બીજું પ્રેમલગ્ન કાયદેસર માન્ય નથી.


3. IPC ધારા 494 – બીગેમી (દ્વિપતિત્વ) માટે ફોજદારી દંડ:

“કોઈ વ્યક્તિ પાસે પતિ અથવા પત્ની જીવિત હોય અને એ છતાં બીજું લગ્ન કરે, તો એના માટે સાત વર્ષ સુધીની જેલ અને દંડ થઇ શકે છે.”


4. IPC ધારા 495 – પૂર્વ વિવાહ છુપાવવાનો ગુનો:

“જો વ્યક્તિ પહેલાનું લગ્ન છુપાવે છે, તો દસ વર્ષ સુધીની જેલ અને દંડ થઇ શકે છે.”
